TERMS AND CONDITIONS FOR USE

NH HOTELES, S.A.

  1. The current promotion is directed at participation by people over the age of 18 who register between the authorised dates of the promotion on the website or any site which is carrying out this promotion. Participation is completely free.
  2. In order to participate it is necessary to register properly and complete the review in less than 100 words, only during the dates of the promotions validity. Once registered, each participant can participate only once, however participants can send out invitation emails to family and friends. Anyone who has complied with the required prerequisites has the right to participate.
  3. The dates of participation are between 7th August 2009 and 30th September 2009.
  4. The prize consists of a two night stay in any 3 or 4 star NH Hotel. The 2 night stay can be used on any weekend in the calendar year 2009 (Friday & Staurday night). However the prize excludes the following NH Hotels: Hotel Almenara, Schlosshotel-Buehlerhoehe, Grand Hotel Timeo, Hotel Villa Sant Andrea, NH Riviera cancún Luxury Resorts, NH Real Arena Punta Cana..
    The prize only consists of what has been previously stated. Any additional costs for traveling, services or consumption which are not expressly included in the description will be the exclusive responsibility of the competition winners.
  5. There will be 2 winners. The first winner will be the participant with the highest number of votes obtained from the total number of votes cast by the rest of the participants and users.
    The second prize awarded is the same prize as for the first winner. It is obtained by referring the first competition winner to the competition website. After entering their competition content, participants are given a unique competition number and a unique link to the competition webpage. If the winner of the first prize used a user’s link to access the competition page, then the user who posted the link will win the second of the competition reward. A user’s personal link can be posted anywhere they choose and there is no limit to the number of people who can access to each link.
  6. Voting closes on the 31st October 2009.
  7. The winners will be notified by email using the details taken during the registration and they must consent to the publication of their name on the NH website as the competition winners and must return a signed authorization within a maximum of 5 working days.
  8. In order to receive the prize the winners must validate his/her information details by presenting a National identity document from their country of origin or a valid passport. The winners must prove at least: name, surname, email address and age.
  9. In case, for whatever reason, the winners cannot use the prize, cannot validate the details given on the registration form or cannot be contacted with the news that they have won, the prize will be given to the person with the second highest number of votes and this will happen until a winner is eventually found.
  10. The prize will only be given to the person who completely satisfies the conditions of participation.
  11. In no case will NH Hoteles give the monetary value or partial monetary value of the prize to the prize winner.
  12. Employees of the NH Hoteles Group and anyone affiliated with them cannot participate in the competition.
  13. All taxes that fall on top of the prize are the exclusive responsibility of the winning participant.
  14. Pursuant to current legislation on Personal Data Protection, we inform you and you expressly consent, that the Personal Data that you provide in this form may be subject to computerized processing and incorporated to files that are the property of NH HOTELES, S.A, for the purpose of this promotion, for rendering the services, administrative and bookkeeping management and to keep you informed, either by telematic or traditional means of news, products and services related to NH HOTELES, S.A, or third party partner companies. Furthermore, you expressly consent to your data being transferred, even outside the European Union, to companies and affiliates of the Group NH HOTELES, S.A., in all cases complying with personal data protection law. You have the right, free of costs, to oppose, access, correct and cancel your data, and revoke your authorization, although not with retroactive effect, under the terms and pursuant to the procedures specified in current legislation on Personal Data Protection, which request should be made in writing and addressed to NH HOTELES, S.A., Calle Santa Engracia, num. 120, 28003, Madrid, Spain or by sending an e-mail to info@nh-hotels.com.
  15. Anyone who writes comments, texts or any other type of information, is obliged to follow the following conditions, not to slander, abuse, harass, threaten or perform any type of discriminatory comment with respect to others; not defending illicit activities; not using indecent, obscene or pornographic language or images; not offering content which is not related to the competition created by NH. Participants are exclusively responsible for the use of conversations, comments and other similar areas of text on the NH website. Never the less, NH Hoteles assume no responsibility for content, information, text or the accuracy of any information included in conversation, comment or field areas on the NH Hoteles website.
  16. Participation implies that participants and users have read and understood the present terms and conditions and have agreed to follow them.
  17. For any controversy, Spanish legislation is applicable. For the settlement of any disputes that may arise between NH and the user, expressly waiving their own or any other venue that may correspond to them, agree to abide by the jurisdiction of the Courts and Tribunals of the city of Madrid. This contract constitutes the total and complete agreement between NH and the user and substitutes all previous pacts, undertakings, statements and agreements, whether written or oral, that may have existed previously between both parties.
